These General Terms and Conditions apply to all offers, bookings, and agreements concluded by MS Tourism B.V. (hereinafter: “we”, “us”, “our” or “MS Tourism”) as an incoming Destination Management Company (DMC) and travel organiser with our clients (travellers, travel agents, tour operators – hereinafter: “you” or “the Client”).

These terms comply with Dutch law (Burgerlijk Wetboek), the EU Package Travel Directive (Directive (EU) 2015/2302), and where applicable, the ANVR Traveller Terms (2026 version). In case of conflict and if we are an ANVR member, the ANVR Traveller Terms prevail.

  1. Booking and Contract 1.1 A booking becomes binding upon our written confirmation (email, voucher, or contract). 1.2 You must provide accurate and complete information (full names as in passport, passport numbers, dates of birth, special requests, etc.). Any inaccuracies may lead to additional costs or cancellation without refund. 1.3 The contract is governed by Dutch law. Disputes shall be submitted exclusively to the competent court in Amsterdam.
  2. Pre-Contractual Information and Standard Information Form Before the contract is concluded, we provide the mandatory pre-contractual information as required by the Package Travel Directive, including:
  • Main characteristics of the travel services;
  • Total price including taxes, fees, and possible additional costs;
  • Payment terms and schedule;
  • Minimum number of participants (if applicable);
  • General information on passport/visa requirements;
  • Our insolvency protection details (name of guarantor, contact, coverage for refunds/repatriation).

A standard information form is provided separately or linked in the booking process, confirming that your booking is a package travel contract under Directive (EU) 2015/2302, granting you all EU traveller rights (liability for performance, price change limits, termination rights, etc.).

  1. Prices and Payment 3.1 Prices are quoted in EUR and include VAT unless stated otherwise. 3.2 A deposit of 30-50% (as specified in the offer) is due upon confirmation; the balance is due [30-60] days before arrival. 3.3 Late payments entitle us to cancel the booking and retain the deposit.
  2. Cancellation and Changes by You 4.1 Cancellation fees (unless otherwise agreed in the specific offer):
  • More than 60 days before arrival: deposit forfeited (administrative costs).
  • 45–60 days: 35% of total price.
  • 30–45 days: 50%.
  • 15–30 days: 75%.
  • Less than 15 days or no-show: 100%. 4.2 Changes (name changes, date shifts) may incur fees (€25-50 admin + supplier costs). 4.3 You may transfer the booking to another person (on reasonable notice, possible costs).
  1. Changes, Cancellation by Us, and Force Majeure 5.1 We may make minor changes; significant changes allow you to accept, seek alternative, or cancel with full refund. 5.2 We may cancel for unavoidable and extraordinary circumstances (force majeure, e.g., natural disasters, war, serious health risks). In such cases, we offer refund or alternative. 5.3 If we cancel for other reasons, you are entitled to refund and possible compensation (unless due to your fault).
  2. Performance and Liability 6.1 We are responsible for proper performance of the package, even if services are provided by third parties. 6.2 In case of non-conformity, you must inform us without delay. We will remedy within reasonable time or offer price reduction/compensation. 6.3 Liability is limited as per Dutch law and Directive (max 3x package price per traveller, except personal injury/death).
  3. Insolvency Protection We have insolvency protection in place [specify: e.g., via Stichting Garantiefonds Reisgelden (SGR) if member, or other approved insurer/guarantor]. This covers refund of payments and repatriation if transport is included. Contact details provided in booking confirmation.
  4. Complaints and Assistance Any complaints must be reported immediately to our local representative/on-site contact. If unresolved, submit in writing within 30 days after return. We provide 24/7 emergency assistance contact.

  6. Final Provisions These terms can only be deviated from in writing. Invalid provisions do not affect the remainder.
